These Terms of Use (“Terms”) govern your use of the ENV QuickDraw App (“App”) developed and provided by Custom Data Processing, Inc. (CDP), Inc. By downloading, installing, or using the App, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree to these Terms, you must not use the App.

Description of ENV QuickDraw App

The ENV QuickDraw App provides an intuitive, scalable drawing solution that enables users to create accurate, permit-ready site plans with advanced annotation and object management features. It offers offline capability and long-term editability through a dedicated file format, helping reduce errors during permit submissions.

License

CDP grants you a non-exclusive, non-transferable, limited, terminable at CDP’s sole discretion, license to install and use one copy of the App on your personal device for non-commercial or internal business use. You may not:

• Modify, copy, or create derivative works of the App.
• Use the App for unlawful purposes or any commercial purpose other than internal organizational use.
• Attempt to decompile, reverse engineer, or otherwise derive source code.
• Remove or obscure copyright notices.
• Distribute, sublicense, rent, lease, or transfer the App to another person.

This license automatically terminates if you violate these Terms. CDP reserves the right to suspend or revoke access at any time for security, compliance, or other legitimate reasons or in its sole discretion. Upon termination, you must uninstall the App and destroy all copies in your possession.

Ownership

All rights, title, and interest in and to the App, including all intellectual property rights, remain the exclusive property of CDP, Inc. These Terms do not grant you any ownership interest in the App or any related materials.

User Responsibilities

You agree to use the App only in compliance with all applicable laws and regulations. You may not use the App for any illegal, fraudulent, or harmful activity.

Offline Operation and Internet Use

The App operates primarily offline, using Internet access only to check for updates and redirect you to the official app store for downloading newer versions. The App does not collect or transmit user data or analytics over the Internet.

File Access

The App may request permission to access your device’s file system to allow you to open, create, save, import, or export project files. All file operations are fully under your control. You are solely responsible for maintaining backups of your files and complying with all applicable laws, including export control and intellectual property regulations. CDP is not liable for any loss, corruption, or deletion of data resulting from your use of the App.

Logs and Support

The App may generate technical logs to assist with troubleshooting. These logs remain stored locally and are never transmitted automatically. You may choose to share logs with CDP Support to help diagnose issues, and any shared logs will be used only for support purposes and deleted after the case or issue is resolved.

Disclaimer

The App is provided “as is” without warranty of any kind, including implied warranties of merchantability, fitness for a particular purpose, or non-infringement. CDP makes no warranty that the App will operate without interruptions or errors or that defects will be corrected. You assume full responsibility for your use of the App and any results obtained from it.

Limitation of Liability

To the maximum extent permitted by law, CDP and its suppliers shall not be liable for any damages arising from the use or inability to use the App, including loss of data, business interruption, or indirect or consequential damages, even if CDP has been advised of the possibility of such damages. Some jurisdictions do not allow such limitations, so these limitations may not apply to you.

Reverse Engineering and Modifications
You may not reverse engineer, decompile, or disassemble the App or otherwise attempt to derive its source code, except as permitted by applicable law. You may not modify or create derivative works of the App.

Indemnification

You agree to indemnify and hold CDP harmless from any claims, damages, or expenses arising from your misuse of the App or violation of applicable laws.

Third-Party Services

The App may interact with third-party services or platforms (e.g., app stores). You agree to comply with all applicable third-party terms. CDP is not responsible for third-party services or their data practices.

Export Restrictions

The App may be subject to U.S. export control laws, and you agree to comply with all applicable export regulations.

Updates and Modifications

CDP may update, modify, or discontinue the App or any portion thereof at any time without notice. By continuing to use the App after an update, you agree to the modified version of these Terms.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Illinois, USA. Any disputes shall be resolved exclusively in the state or federal courts located in that state. Where permitted by law, arbitration and waiver of class actions apply.
